In February 2004, a majority on Canada’s Supreme Court (Harper v. Canada) endorsed severe restrictions on political speech – the constitutional right to free expression – on the grounds that there was a “danger that political advertising may manipulate or oppress the voter.”
But shielding Canadians in that case was a sharp change of direction from a previous decision in 2001. In Canada v. Sharpe, self-created child pornography was permitted on the claim that such individually created erotica was not proved harmful to society – thus an unjustified and too-great infringement on the constitution’s guarantee to freedom of expression. Why did they not take a similar, cautious just-in-case approach to self-created child pornography? Where should the boundary be?
Drawing on excerpts from his new book, Mark Milke will discuss the high court’s differing approaches to freedom of expression. Please join us for this controversial discussion!
